本服務條款 (以下稱「本合約」）是由 Genuine Studio Limited (以下稱「本公司」) 所提供的遊戲程式（以下稱「本程式」）的使用條件，由使用本程式之用戶與本公司之間訂定的條款。 在訪問或使用本服務之前，您須同意並遵守本合約和本合約內《服務條款》和《私隱條例聲明》的相關規定。在使用相關服務前您還需註冊一個帳戶（“帳戶”）。在通過註冊帳戶或其他方式使用服務時，您須承諾您已滿21歲並且已經理解並同意本服務條款的各項條款。對於21以下歲的用戶，您須保證您的法定監護人已經審閱並同意本服務條款的各項條款。如果您通過社交網站（“SNS”），如Facebook或Google+訪問服務，您須同時遵守該社交網站的服務條款及本服務條款的相關規定。

用戶一旦使用本程式，將視為同意受本合約之約束並且遵守以下所列的所有條款。若用戶不同意本合約以下之條款，您須立即停止使用本程式。 本公司有權通過在本頁上公佈修訂條款，在任何時候自行決定變更、修改、增加或刪減本合約的相關條款。您如果繼續使用相關服務，則視為您接受上述變更。如果您在任何時候不同意屆時有效的合約條款，或本公司任何其他政策、規則或行為準則中的任何內容，對您使用服務的許可應立即終止，您須立即停止使用服務。

使用權之授予：

本公司授予用戶非獨占性、不可轉讓之使用權利，僅予用戶使用本程式於私人或非商業用途。用戶明確瞭解此使用權並未販賣、轉讓或分配本程式的產權及所有權。本公司將保留本合約內未明文授予的所有權利。

所有權：

本程式以及其相關著作之資料、其著作權、專利權、商標、商業機密、其他智慧財產權, 所有權或其他權利，均屬本公司所有。除事先經本公司之合法授權外，用戶不得擅自複製、分佈、重製、傳輸、改作、編輯或以其他任何形式，或基於任何目的使用或授予他人使用。

服務條款：

同意自行負擔進行本程式時所需的所有硬體、軟體、及其它產品與服務的費用與稅項。

同意在使用本程式及其相關服務時提供真實而正確的個人資料。

自行妥善保管本程式的帳戶ID和密碼。

不可使用侵犯任何的版權及商標，被認為不雅或可能引起法律糾紛之文字作為用戶名稱。

不可使用任何第三者軟體進行任何修改本程式之行為或影響本程式之進行。

不可使用本公司的任何智慧財產權來創造或提供程式的連線服務，如模擬伺服器等。

不可對本程式進行還原工程、解碼、反向組譯、或創造衍生作品。

不可對本程式的伺服器採取任何侵入行為，或嘗試使伺服器過度負荷。

不可販賣任何本程式內的虛擬角色、物品、金錢以及其他版權所有物品。

不可上傳含有侵犯第三者的知識產權、版權或公眾/私人權利，違反任何法律或道德權限，譭謗他人、性騷擾、種族歧視、或有不良影響的內容，病毒、特洛依木馬、定時炸彈等可能對系統造成傷害或影響其穩定性的內容。

 

軟件更新：

本程式在日後隨時會進行更新以增進遊戲各項功能，用戶明確瞭解日後是可能無法順利使用本程式之更新版本。除非個別更新版已附有其他合約或條款，否則本合約將適用於日後本程式所有的更新版本。

私隱條例聲明：

為能提供更好的遊戲體驗，本公司會收集用戶的個人資料作參考及統計。以下聲明描述了本公司將如何使用，處理，收集，共享，傳遞，並保護用戶的資料。

關於用戶使用本程式的資訊

關於用戶使用本程式進行註冊或登入時所提供的資料

關於用戶使用本程式時的交易紀錄資料

個人資料的披露

用戶向本公司提供的個人資料將予保密。惟此等資料可向提供服務的僱員、代理、服務提供者及顧問披露（或他們可接觸或得悉此等資料），藉以協助達成收集資料所涉的目的。用戶的個人資料也可供予本公司在媒體資訊和開發遊戲範疇的業務伙伴作直接促銷之用。用戶可要求停止任何個人資料使用於上述的直接促銷目的。倘若如此，請使用電子郵箱 Jauns@genuine-studio.com 與本公司聯絡。

資料保安

本公司將採取合理的技術和措施以防止用戶的個人資料遺失，或遭濫用及更改。然而，本公司對於在本程式內由第三方提供的私隱條例並不負上責任。

除非法律特別規定，否則當最初收集資料的目的完成後，本公司將採取所有合理及切實可行的步驟刪除您的個人資料。

修訂及終止合約：

本公司可以隨時對此合約進行修訂。若合約有任何修訂，用戶會在登入本程式時得到通知，針對合約的修訂將在本公司進行通知動作之後即時生效。倘若用戶不同意新修訂的授權協議，或基於任何理由無法遵守新修訂的協議，亦可即時停止使用本程式。本公司同時保留權利可隨時停止、更改本程式各項服務內容、限制任何用戶的帳戶服務，且無需事先通知。用戶亦可隨時終止本合約，但必須立即銷毀本程式及其複製品。若用戶違反本合約之任何條款，本程式之使用權將自動終止。

免責聲明：

用戶清楚瞭解及同意自行承擔使用本程式時的所有風險，在相關法律所允許之最大範圍內，本程式是依據「現狀」提供，不附帶任何形式的擔保，不論其為明示、默示或法定的，包括但不只限於安全性、可靠性、正確性、完整性、有效性、特定目的的適用性、安全等相關缺陷、錯誤或程式錯誤、權利侵害等。

責任限制：

在相關法律所允許之最大範圍內，本公司在任何情況下均不對用戶在使用本程式或不能使用本程式時所產生的任何損失承擔責任，包括但不只限於利潤損失、營業中斷、遺失數據、直接性、間接性、衍生性或偶然性的損害、損失或任何形式的費用，不論責任的形式是在合同，侵權（包括過失)，嚴格產品責任或其他原因，即使本公司已被告知此類損害的可能性。

其他細則：

本合約是根據香港特別行政區的法律來訂立及闡釋，若本合約有任何一部份無效或無法執行，並不影響其他部份的有效性。在使用本程式時, 用戶同意服從香港法院的專屬司法管轄或遵守所在國家之相關法律規定。本合約內容如於其他語言版本中有不同之處, 該以此中文版本為準, 如用戶對本合約尚有任何問題，請依本公司或本程式之網頁所指定的方式聯絡。

Privacy Policy

IMPORTANT: PLEASE READ CAREFULLY.

This is a legal agreement between you and Genuine Studio Limited (hereafter referred as "GS" or “us” or “we”) that governs your use of GS’s “Kobayashi Masayuki” applications (hereafter referred as "App").

Before accessing or using any of our App, you must agree to this End User License Agreement (hereafter referred as “Agreement”) including accompanying Terms of Service and Privacy Policy. You may also be required to register an account on the Service (an “Account”). By registering for an Account or otherwise using the App, you represent that you are age 21 or older and you understand and agree to these Terms of Service. If you are under the age of 21, you represent that your legal guardian has reviewed and agreed to these Terms. If you access the App from a Social Networking Site (“SNS”), such as Facebook or Google+, you shall comply with their terms of service/use as well as our Agreement.

If you do not agree to the terms of this Agreement, please do not use the App. By using the App, it means that you accept to be bound by the Agreement and comply with all of the following terms.

Genuine Studio Limited reserves the right, at its discretion, to change, modify, add or remove portions of this Agreement at any time by posting the amended terms on this page. You will be deemed to have accepted such changes by continuing to use the App. If at any point you do not agree to any portion of the then-current version of our Agreement, your license to use the App shall immediately terminate, and you must immediately stop using the App.

Grant of a limited use license

Subject to this Agreement and its terms and conditions, Genuine Studio Limited hereby grants you a non-exclusive, non-transferable license to use the App, only for your personal or non-commercial purposes. You hereby acknowledge that the App is being licensed to you, not sold, and no title or ownership in the App is being transferred or assigned. Genuine Studio Limited reserves all rights not expressly granted in this Agreement. Any use of the App in violation of this Agreement is strictly prohibited, can result in the immediate revocation of your limited license and may subject you to liability for violations of law.

Ownership

All publishing rights, copyrights, patents, trademarks, trade secrets, and other intellectual property rights, ownership or other rights, in or connected with the App are owned by Genuine Studio Limited. Unless expressly authorised by Genuine Studio Limited, you are prohibited to copy, distribute, reproduce, transfer, convert, edit, or in any form, or in any purpose, to use or authorise others to use.

Terms of Service

You are responsible for all taxes and costs of acquiring any hardware, software, other products or services that required for using the App.

Your username should not violate to any copyright and trademark, and should not use offensive or any inappropriate wording that may cause us any legal liability.

You acknowledge that the personal information provided for your use of the App and its services is authentic and accurate.

You are responsible for safeguarding your own in-App ID and password.

You may not to reverse engineer, decompile, disassemble, or create derivative works of the App.

You may not use any third-party software to modify the App, or intercept its processing.

You may not use the Genuine Studio Limited's intellectual property rights, to create, facilitate or maintain any connection to the App, such as the server emulator.

You may not hack to the App's or Genuine Studio Limited's server or attempting to make the server overload.

You may not sell, or transfer reproductions of the game characters, objects, credits or any related products, which are own or licensed by Genuine Studio Limited.

You may be allowed to create and upload the content to the server when accessing the App. The upload content must not: infringe any third party's intellectual property rights, copyrights, or public/private rights; violate of any legal or moral rights; defame, sexual harass and race discriminate, or with adverse effect to the others; contain viruses, Trojan horses, and time bombs, or any other similar material that may damage the system and its stability.

Application Updates

The App will be updated at any time for upgrades and additional features, Genuine Studio Limited does not guarantee for your consistent use of the App. You hereby acknowledge that you may not able to process the update. This license shall apply to any update version of the App that is not distributed with a separate license or other agreement.

Privacy Policy Statement

In order to provide better services and games, Genuine Studio Limited will collect some of your personal information and this Privacy Policy describes what information we collect, how we use, handle, collect, share, transfer and protect the information.

Collection of Personal Data

Genuine Studio Limited may collect and use the following personal information:

Information about your use of this App;

Information that you provide using for the purpose of registering with the App;

Information about transactions carried out over this App;

Any other information that you send to Genuine Studio Limited.

Use of Personal Data

Your personal information will be used in the way of:

administer this App;

enable your access to and use of the App;

publish information about you on the App;

send you the products that you purchase;

supply you the services that you purchase;

send you marketing communications.

Disclosure of Personal Data

Personal data supplied to Genuine Studio Limited will be kept confidential. However, we may disclose such data to or such data may become accessible or known to employees, service providers and consultants of Genuine Studio Limited who provide services to assist in fulfilling the purposes for which it was collected. Your personal data may also be disclosed for developing new services, games and advertising. You may opt out of receiving those direct marketing notification by sending written notice to our email: cs@gamemiracle.com stating “Opt Out”.

Data Retention

Unless there is a specific legal requirement for us to keep the data, we will take all reasonably practicable steps to erase your personal data that is no longer required for the purposes for which the data was originally collected.

Securing Your Data

Genuine Studio Limited will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. However, Genuine Studio Limited is not responsible for the privacy policies or practices of any third party from the links to other websites within the App.

Updating This Statement

Genuine Studio Limited may update this statement by posting a new version of the App. You should check this statement occasionally to ensure you are familiar with any changes.

Amendment and Termination

This Agreement with the accompanying Terms of Service and Privacy Policy shall commence upon your acceptance of the terms and conditions set forth herein and continue thereafter until terminated. For any future changes to this Agreement, notice will be given once you access to the App and the amendments will immediately effective. Genuine Studio Limited reserves the right to modify, supplement or delete, at any time, any of the terms and conditions of this Agreement. If you do not agree to, or not able to comply with the new terms, your license to use the App is terminated and you must not use the App anymore. Genuine Studio Limited reserves the right to terminate or modify the App, or your access to the App for any reason, at any time, and without notice to you. You may also terminate this Agreement at any time by destroying all copies of the App in your possession or control. In the event that you breach any one of the terms within this Agreement, the license will terminate automatically.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND, AND Genuine Studio Limited HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APP, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL Genuine Studio Limited BE LIABLE TO YOU FOR ANY LOSS ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APPLICATION, INCLUDING, BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, INTERRUPTION OF BUSINESS, LOSS OF DATA, OR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, REGARDLESS OF THE FORM OF LIABILITY WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY OR OTHERWISE, EVEN IF Genuine Studio Limited HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Miscellaneous

This Agreement shall be governed by, and construed in accordance with, the laws of Hong Kong Special Administration Region, if any part of this Agreement is held invalid or unenforceable, the remaining parts of this Agreement shall be unimpaired and remain in full effect. You agree to be restricted by the exclusive jurisdiction of Hong Kong, and also subject to other relevant international laws for your use of the App.
